This comprehensive document contains our official Terms of Service, Anti-Scraping Restrictions, Account Commitments, E-Gift Certificate Rules, and Privacy Policy. By accessing this website, booking driving packages, purchasing gift certificates, or participating in our professional training, you expressly agree to be bound by all terms, conditions, and legal policies outlined below. If you do not agree, you must immediately cease using our platform.

Part 1

Intellectual Property & Anti-Scraping

All text, code, layout structures, pricing tables, graphics, social media metrics, and custom 2D and 3D instructional driving maneuver animations or diagrams displayed on this website are the sole intellectual property of Sky Driving School Ltd. and are protected under Canadian and international copyright laws.

Prohibition of Content Theft: You are strictly prohibited from copying, reproducing, republishing, downloading, distributing, or modifying any portion of this website's text or media assets for commercial use, secondary business directories, automated re-hosting, or cloning without express written permission from Sky Driving School Ltd. Unauthorized Re-hosting: Scraping our proprietary text to third-party domains or fake local directories is a direct violation of our copyright. We enforce our rights aggressively via formal DMCA takedown requests sent directly to search engines and web hosts to have infringing URLs permanently scrubbed from search indexes.

Automated Data Collection Ban: You must not conduct any systematic or automated data collection activities including but not limited to scraping, data mining, data extraction, and data harvesting on or in relation to our platform without our express written consent.

Firewall Monitoring: We actively monitor traffic using advanced firewall defense systems including Wordfence. Any automated entity, server data center, or script found executing excessive requests or attempting to scrape data in bulk will be instantly and permanently blacklisted via IP blocking.

Privacy Policy & Data Protection

Sky Driving School Ltd. operates in strict compliance with the British Columbia Personal Information Protection Act (PIPA). We only collect personal data that is strictly necessary to provide professional driver training and to fulfill our legal obligations under the BC Motor Vehicle Act.

1. Categories of Information We Collect

We collect information directly from you when you register, book a lesson, or communicate with us:

  • Student Identity Data: Your full legal name, age, mailing address, contact phone number, and email address.
  • Licensing Data: Your British Columbia Driver's License number, classification, restrictions, issue date, and expiry date.
  • Training & Progress Logs: In accordance with ICBC regulations, we log your lesson dates, total hours trained, evaluation scores, instructor feedback comments, and vehicle information.
  • In-Car Surveillance Information: For liability, insurance, and the ongoing safety of both our students and instructors, all training sessions are recorded via internal video and audio dashcam technology inside the vehicle.
  • Transaction Data: We collect billing information through our payment gateway. All credit card transactions are processed securely and encrypted via Square. We do not store full credit card details on our local systems.

2. How We Use and Share Your Information

We use your data solely to execute, manage, and track your in-car driving lessons and prepare you effectively for your ICBC road test. We do not sell or trade your data to third-party marketers. Your data is only shared under the following conditions:

  • Division 27 Compliance: As a licensed driver training school under the Motor Vehicle Act (Division 27), we are legally required to disclose student records, identities, and training metrics to the Insurance Corporation of British Columbia (ICBC) upon their official request.
  • Service Providers: We share minimum necessary data with trusted partners such as our web hosting providers and secure payment processor Square solely to operate our online booking engine.
  • Legal & Safety Mandates: We cooperate with law enforcement and government officials to enforce the law. We may disclose personal data to respond to subpoenas, court orders, or in emergency situations where public safety or an individual's physical security is threatened.

3. Media Release & Social Media Participation

At Sky Driving School Ltd., we celebrate our students' success. When a student successfully passes their ICBC road test, we may request to take a photograph or a short video of the student with the Sky Driving School Ltd. training vehicle. By consenting to this media capture, you grant Sky Driving School Ltd. the non-exclusive right to use these images and videos on our official website, social media channels including Facebook, Instagram, TikTok, YouTube, Vimeo, and Google Business Profile, and digital marketing materials to showcase student success.

  • Voluntary Nature: Media participation is entirely voluntary. Students may decline or withdraw consent at any time by informing their instructor.
  • No Compensation: There is no financial compensation or royalties associated with the use of these images.
  • Privacy: We will not post a student's full name, license information, or contact details alongside media without obtaining specific, separate written permission.
  • Students Under 19: For students under 19, media consent must be provided by a parent or legal guardian. By completing the booking on behalf of a minor, the parent or guardian confirms consent for media use upon successful road test completion.

4. Third-Party Service Providers

To provide our professional services, we utilize the following third-party platforms that may collect, process, or store data on our behalf:

  • Booking & Scheduling: Bookly manages our online lesson booking and collects student contact and scheduling information.
  • Payment Processing: Square processes all payments securely. We do not store full credit card details on our local systems.
  • Website Infrastructure: WP Rocket (performance optimization) and SiteGround (hosting) process site data in accordance with their respective privacy policies.
  • Analytics & Performance: Google Analytics monitors website traffic and may set cookies for up to 2 years. Google Fonts serves typefaces via Google servers.
  • Security: Wordfence provides firewall protection, security monitoring, and traffic analysis to protect your data and our intellectual property.
  • Social Media & Video Hosting: We utilize platforms including Facebook, Instagram, TikTok, YouTube, Vimeo, and Google Business Profile to host content and showcase student success. These platforms process data in accordance with their own respective privacy policies.
Part 3

User Accounts, Representations & Conduct

Legal Capacity: You confirm that you are legally able to enter into a binding contract or have the explicit consent of a parent or guardian if you are under the legal age.

Data Accuracy: You guarantee that all information provided to us through the registration or booking process is true, current, and complete, and you commit to keeping this information accurate.

Account Access Security: You are entirely responsible for maintaining the confidentiality of your platform credentials and password. Sky Driving School Ltd. will not be held liable for losses incurred by unauthorized third-party usage of your account, and you accept sole financial responsibility for any activity logged under your account profile.

System Interference Ban: You agree not to interfere with, disrupt, probe, scan, or breach the security infrastructure of our servers, website networks, or backend database systems. Violations will result in immediate IP blacklisting and referral to local law enforcement.

Parental or Guardian Consent: If you are booking on behalf of a student who is under 19 years of age, by completing this booking you confirm that you are the parent or legal guardian of that student. You agree to all terms and conditions on their behalf and accept full financial responsibility for all lesson fees, cancellation fees, and any other charges incurred. If you are under 19 and booking yourself, you confirm that your parent or legal guardian has given their consent for you to book and participate in driving lessons with Sky Driving School Ltd.

Part 4

Lessons, Cancellations & Fees

Mobile Format: Sky Driving School Ltd. is a mobile driving school. Instructors provide pickup and drop-off services at your home, school, or workplace across Victoria, BC.

Office Visits: You are welcome to visit our office at 2210 Quadra St #3, Victoria, BC V8T 4C6. Appointment required to ensure someone is available for you. Please call or book online before visiting.

Licensing Requirements: Students must present a valid British Columbia Learner's License (Class 7L) or higher at the absolute start of every in-car lesson. If a student fails to present a valid physical license, the lesson cannot proceed and will be treated as a late cancellation, incurring full lesson fees.

Strict 48-Hour Cancellation Policy: Cancellations, reschedules, or modifications to booked lessons must be requested a minimum of 48 hours before the scheduled start time. Cancellations made inside the 48-hour window, or student no-shows where an instructor waits 15 minutes at the designated pickup spot, will be charged a $50 late fee processed directly to the payment card on file. For road test appointments booked by Sky Driving School Ltd., a minimum of 72 hours notice is required to cancel. Failure to provide 72 hours notice may result in a $25 ICBC cancellation fee charged to the student.

Regional Surcharges: Lessons conducted in Langford, Colwood, and Saanichton require an additional travel surcharge of $30 per lesson added to each individual booking.

Package Rate Adjustments: The cash value of individual training modules, prepaid accounts, or standard lesson bundles does not expire. However, package lesson pricing is only locked in for exactly one year from the date of purchase. If a student schedules their lessons more than one year after purchase and our rates have increased, current market rates will apply, and the student will be responsible for paying the rate difference before booking.

Vehicle Access: Sky Driving School Ltd. reserves the right to terminate any lesson immediately if the training vehicle is accessed or operated in a manner that compromises the safety of the instructor, the student, or other road users.

Part 5

E-Gift Certificate Terms & Conditions

Sky Driving School Ltd. e-gift certificates are valid for one year from the date of purchase for driving lessons only.

The dollar value of the e-gift certificate does not expire. However, the price is locked in for one year from the date of purchase. After one year, if our lesson prices have increased, the current rate will apply and the recipient will be responsible for paying the difference via E-Transfer before booking.

The e-gift certificate applies only to the standard lesson package purchased. It cannot be used toward road test car rental, road test packages, or any other service not included in the original package.

The e-gift certificate cannot be exchanged for cash and cannot be transferred to another student. It is valid only for the recipient named on the certificate.

Lessons in Langford, Colwood and Saanichton require an additional $30 per lesson added to each booking. This applies when redeeming an e-gift certificate for lessons in these areas.

Sky Driving School Ltd. reserves the right to refuse redemption of an e-gift certificate if the terms and conditions are not met or if the certificate cannot be verified.

Disclaimers & Limitation of Liability

As-Is Provision

To the maximum extent permitted by applicable law, this website and its free informational content are provided as-is without express or implied warranties of any kind, including accuracy, security, or fitness for a particular purpose.

Limitation of Liability

Sky Driving School Ltd., its directors, employees, and authorized contractors shall not be liable to you or any third party for any indirect, incidental, consequential, special, or punitive financial damages arising from website interactions or training courses. Our total aggregate liability under any circumstance will never exceed the total dollar amount paid by you to our school in the 3-month period preceding a formal claim.

Course Outcome Disclaimer

While our custom blueprints and 3D mock maneuvers offer premier road training, usage of our instructional platform does not legally guarantee a passing score on official independent ICBC road examinations.

Zero-Tolerance Safety Policy

We maintain a zero-tolerance mandate for verbal abuse, intimidation, reckless behavior, or physical threats directed toward our instructional staff or third-party road users. Any violation will cause immediate permanent termination of your course packages without a refund, and vehicle video records will be handed over to local law enforcement immediately.

Part 7

Governing Law & Legal Jurisdiction

This Agreement, website compliance, and all business relationships between students and our organization shall be governed and interpreted solely under the laws of the Province of British Columbia, Canada. You irrevocably agree that the exclusive legal venue for any formal disputes, actions, or mediation proceedings shall be the courts located in Victoria, British Columbia.
